It is designed to make submitting notices of alleged infringement to TurkReno Incorporated as straightforward as possible while reducing the number of notices that we receive that are fraudulent or difficult to understand or verify. Counter Notification

The provider of affected content may make a counter notification pursuant to sections 512(g)(2) and (3) of the Digital Millennium Copyright Act (DMCA). When we receive a counter notification, we may reinstate the material in question.

To file a counter notification with us, you must provide a written communication (by fax, regular mail or email) that sets forth the items specified below. Please note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney or appropriate legal counsel.

To expedite our ability to process your counter notification, please use the following format (including section numbers):

  1. Identify unique identifying information of material that TurkReno Incorporated has removed or to which TurkReno has disabled access.
  2. Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of the Alabama Southern Federal District Court, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  3. Include a clear reference to the legal basis for your counter-notice, such as one or more of the following statement:
    1. The material in question is not copyrighted or the copyright has expired.
    2. The Complainant has provided no copyright registration information or other tangible evidence that the material in question is in fact copyrighted, and I have a good faith belief that it is not. The allegation of copyright violation is therefore in dispute and at present unsupported.
    3. The Complainant does not hold the copyright to the material in question and is not the designated representative of the copyright holder and therefore lacks standing to assert that my use of the material is a violation of any of the owner’s rights.
    4. My use of the material is legally protected because it falls within the “fair use” provision of the copyright regulations, as defined in 17 USC 107.
